Tonight, Lawrence O'Donnell on "The Last Word" gave voice to a theory I had been mulling over the past couple of days, but I hesitated to post it here because it's just too batshit crazy.

The theory is this.  The shutdown of the federal government by House Republicans is not accidental, not unintended, not collateral. It is, in fact, the main event.

A Main Event aimed at one larger goal -- to irrevocably damage Obama's presidency.  If the government is in crisis, if the US defaults and the economy takes a huge hit and the world economic system swerves radically away from US bonds under Obama's tenure as President, he'll go down in history as the president under which the US became a Third World nation.  

It will be proven that Negroes cannot govern the country.

They have been saying for years that their main goal is to destroy Obama. They were unable to prevent his reelection, so they will do whatever they can to destroy his reputation. I think the fact that Obama is black is only a small part of their reasoning - but one that provides extra ammunition in some areas - they just hate Democrats.

Maybe a case could be made, but it would be a piss poor case and laughed out of court.

A better case could be made for malfeasance. Unfortunately, the Constitution gives Congress the right to make its own rules. So as long as they are playing by the rules, the best we could hope for would be misfeasance, and I'm sure there are loopholes that would free them from any punishment for that as well.

Only if they violate some law which applies to everyone, and even then they tend to be let off lightly by the courts.

If they fuck up too badly - and publicly - in the course of their duties, then they can be investigated by the ethics committee of the House or Senate. The worst punishment they can receive in this manner is expulsion. In its history, there have been a total of five members of the House expelled and fifteen members of the Senate (fourteen of them for supporting the Confederacy).

The shutdown itself will not affect the implementation or funding of the healthcare act. The Republicans are using this action as a tactic to extort a delay in the implementation of the act. They will use the debt limit to try the same extortion.

I believe that these actions are blatantly illegal. The Justice Department should look into the matter and keep the public informed at every step of the investigation.

The shutdown only affects discretionary spending and programs. Something like two thirds of federal spending is mandatory (required by existing law) and so it continues. Portions of the government which are classified as non-essential will not be funded and must be shut down. Why Congress is not classified as non-essential is a question I can't answer.
