We spoke earlier of States and smaller jurisdictions deciding to ignore and disobey Supreme Court rulings with which they disagree. SCOTUS has no enforcement mechanism, so if they’re making rulings at odds with the will of the majority, their own legitimacy is the piece that breaks. It’s their own fault.

But that recalcitrance swings both ways.

This week Alabama refused a SCOTUS order to redraw their electoral map. In a state 27% African American, the map Republicans drew after the 2020 census created 9 majority white districts and 1 majority black. What will be the outcome of this defiance? Stay tuned.

In Texas the DOJ ordered the state to remove a floating border wall draped along the Rio Grande. The state has refused to comply.

Such defiance of the rule of law so far goes only one way—Republicans refusing “liberal” court orders—but it certainly could, and arguably should include liberal jurisdictions refusing conservative court rulings.

Where this ends is anyone’s guess.
