PostSubject: Trump's Immigration Ban   Tue Feb 07, 2017 3:29 pm

MSNBC is broadcasting live audio from the emergency 9th Circuit hearing on the Muslim ban. Trump's attorney August Flentje is getting his ass handed to him by the justices.

Looks like an easy upholding.

Flentje's argument, in a nutshell, was this: as Chief Executive Trump is free to make binding policy for the US based on his intelligence briefings.

Which we know, are coming from Steve Bannon and Fox News, not the NSA.

Therefore.... if the stay is granted and Trump loses, his imperial power (and dreams of even greater dictatorial power -- by him and the Heritage Foundation and AFP and PNAC, etc.) will have been stifled less than 3 weeks into his administration. It might spell the beginning of the end of this current powerdive into plutocracy.

I think this is a RILLY Big Deel.

9th Circuit Court just upheld the Washington State judge's overturn of Trump's immigration ban.  This is binding nationwide.

Trump is vowing "see you in court" but it is my understanding, if the 9th CC upholds a lower court, there is no higher authority.  I don't believe the Supreme Court has legal authority to overturn TWO lower courts.

Trump is in for a civics lesson.

The Supreme Court most certainly can overturn the lower court's decision. I do believe DTwill take the case to SOCTUS. If he gets his appointee on the court before the case gets there, it might be overturned. With the Court we have now, it won't.

Huh, I guess they can.  I heard on the news a couple of days ago that they could not;
Quote :
Moreover, as evidenced by Trump's tweet, the administration will almost certainly appeal the 9th Circuit's ruling. That will send the case to the U.S. Supreme Court, where any number of things could happen. The high court could uphold the 9th Circuit's ruling, thus leaving the temporary block in place; it could overturn the previous ruling, which would allow the travel ban to be implemented; it could deadlock 4-4, which would result in the 9th Circuit's ruling standing; or it could refuse to hear the case at all, which would also allow the 9th Circuit's decision to stand.

This uncertainty notwithstanding, Thursday's ruling is a big deal. For one, the Supreme Court does give weight to the lower court's ruling while hearing appeals. In addition, thanks to the empty seat on the court, there's a very real possibility that the justices will reach a 4-4 tie on the case. When that happens, the lower court's ruling stands, so it matters quite a bit that the 9th Circuit ruled against the administration.

Although the legal dispute over the travel ban is far from over, Thursday's ruling was a huge win for opponents of the ban, and just as big of a setback for the young Trump administration.
Nevertheless, I don't think the current court -- except Judge Thomas, who swore in Pence -- is inclined to serve as Trump's lapdog and I would expect them to decline all of his tweets calling for an immediate review of the two lower court rulings.

Civics lesson.

Trump had 55 minutes of Congressional debate over immigration broadcast live yesterday, partially to dispel the growing consensus that he is mentally unstable, partly to give the (false) impression that he's in charge of a bipartisan debate over the issues, and mostly as a publicity stunt.  The congressmen & women in the room were hand-picked.  Agreement was made only AFTER the reporters were shuffled out of the room.  The "agreement" made was basically only an agreement to limit future debate.

However, during the debate Trump "took every position available on the debate" according to several commentators, which, far from displaying leadership, shows what a rudderless, unprincipled, ignorant, spineless wimp he is.

And now he's getting called out for that.

Previously I worked out that it would be mathematically impossible for Trump to achieve impeachment before the end of his first term.

If he manages to sufficiently piss off his Republican apologists however all bets are off the table.  Go Trump go!

Oh this is rich.  Trump said yesterday he'd be in favor of a 'clean' DACA bill, not tied to any other legislation.  This is in direct contradiction to his previous stands and the official Republican party stand.

When the transcript of yesterday's meeting was released -- the meeting that WAS TELEVISED LIVE -- the Republicans had removed Trump's statement from the transcript.

When they were caught they later said it was an oversight.  Yeah right.
