| How about Jerry Brown as Scalia's replacement. The last time a California Governor was on the court it worked out quite well.

In our tri-parte system of government, the Executive nominates a Judicial candidate, and the Legislative confirms. Which makes me wonder... Why can't potential congress members be vetoed by the president? We've already seen SCOTUS pick a president. |

| One good thing: there is a case against Obama's climate change initiative. That was destined to be shot down by the SC, but with Scalia gone, it should survive. |

| I think what we are going to see is a very protracted fight between Obama and the Senate. The Republican Senate will do all they can - legal or otherwise - to prevent approving anyone Obama will put forward for the office. They started their delaying within hours of Scalia's death.

| Yes. What people are suggesting is that Obama nominate people who were approved for their current position 99-0 by the senate. (There are at lest two or three such possibilities). That way, the Democrats can clearly demonstrate that the delay is pure partisan bullshit. |

| Richard, what you are suggesting is the the Republicans will use common sense and that they are subject to being embarrassed, Neither of these are true, as we have seen demonstrated many times in the past seven years.
The Senate is still holding up fairly minor appointments - some for years - just to show what giant assholes they can be. They are proud of their stupidity and blatant partisanship.

Not EXACTLY. The Jane Mayer book makes it clear why they are obstructing Obama: not to be assholes, but to make him look weak and ineffective, at any cost. They feel they need to deny him any successes, at all, so his presidency will go down in history as unsuccessful. The GOP lost the 2008 presidential election and the 2012 presidential re-election, because their message doesn't appeal to the public at large. Getting the 99% to vote against their own self-interest, and for the exclusive benefit of the 1% (or 1% of the 1%) takes some serious "message molding." However they won -- and won BIG -- in the congressional races, giving them a majority in both the House and the Senate. So they have the power of the purse, and the power to control legislation. Everything except presidential executive orders.... So if they can't make their presidential candidates popular, they can at least do their best to make HIM unpopular. And.... They've largely succeeded.
